SOUTH WORKING CHARTER

1. COHESION.

 

The purpose of the Association and of the "South Working - Lavorare dal Sud" ("South Working") project is the promotion of economic, social and territorial cohesion, and the reduction of the gap currently existing between territories with different levels of development. These values ​​are set forth in section 119 of the Italian Constitution and in sections 174-178 of the Treaty on the Functioning of the European Union.

 

2. REMOTE WORKING.

 

The adoption and promotion of agile or "smart working" contracts (pursuant to Law 81/2017), to work primarily remotely and for employers located elsewhere, represents a means chosen by South Working to improve the economic and social ecosystem.

 

3. RELATIVE SOUTH.

 

South Working focuses, in particular, on the revitalization and promotion of the South and of inner and inland areas of Italy. However, the whole of Italy could benefit from the project, attracting talent from the rest of the world. The South is to be understood as a relative concept, because “we are all someone else's South”.

 

4. VOLUNTARITY.

 

South Working is based on the voluntary movement of workers. It opposes forced labor relocation plans. It does not support  the possibility of reducing wages based on the cost of living in the territories where the worker decides to work from.

 

5. NEW WORK CULTURE.

 

South Working promotes adequate training courses for workers in South Working ("South Worker") aimed, among others, at maintaining a healthy balance between private life and work, optimal working conditions and high standards of productivity, no longer associated to the mere physical presence of workers in the office.

 

6. VULNERABILITY.

 

South Working also promotes agile employment contracts in order to introduce new employment opportunities for categories with less access to the labor market or victims of discrimination in the workplace.

 

7. GENDER DYNAMICS.

 

South Working promotes an agile work culture attentive to gender dynamics, to prevent this from becoming the tool to further increase the so-called double workloads or further relegate women to care-giving tasks.

 

8. MOBILITY.

 

South Working promotes and supports mobility initiatives without any geographical and territorial limitation. It therefore defends mobility as a means of personal and professional growth. For those who can leverage it, mobility is a key lever in every social, professional and personal aspect.

 

9. WIN-WIN.

 

South Working intends to propose a new perspective that benefits all the stakeholders involved, rethinking the traditional workplace, social, and cultural dynamics.

 

10. RIGHTS.

 

The protection of workers' rights in South Working is a key point of the project, as better specified in the South Worker Rights Charter, in the appendix.

 

11. MORE INFORMATION.

 

The starting point of South Working is always the study of phenomena in a thorough and critical way, through a South Working Observatory.

 

12. INFRASTRUCTURES.

 

South Working aims to promote advocacy actions for long-term sustainable development of the territory, considering that adequate digital, communication and transport infrastructures are necessary for the development of territories and communities, in particular an Internet network with broadband and an adequate number of flight connections with major European and world cities.

 

13. NETWORKS.

 

In contrast with the current atomization of many social initiatives, South Working intends to create networks between the various categories of stakeholders.

 

14. COWORKING SPACES.

 

South Working does not promote working from home as such but aims to stimulate the development of urban spaces, including coworking spaces, in which the working and social dimensions can be kept together. Coworking are intended as community hubs (in Italian, "presidi di communità"), in which active participation, inter-generational collaboration, care for the local community are key values.

 

15. COMMUNITY.

 

South Working promotes the virtuous interaction between workers and local communities, also through processes of active participation and contrasting the potential negative effects deriving from gentrification (and its implications). It promotes inclusive, lasting and sustainable communities and human settlements, as envisaged by Goal 11 of the UN 2030 Agenda.

 

16. NON-PARTISAN.

 

South Working is a non-partisan entity. If proposals are made to political actors, this will be done across the board and without partisan interests.

 

17. NO PROFIT.

 

South Working activities, regardless of their legal nature, will be non-profit.

 

18. LEGALITY.

 

South Working promotes the culture of legality and the fight against corruption and organized crime, as a fundamental element of the projection of man in the work environment and in society.

APPENDIX: SOUTH WORKER RIGHTS

INTRODUCTION: This appendix describes the rights of the South Worker which shall become fully operational once the state of emergency declared due to the COVID-19 pandemic ends.

1. THE LAW.

 

The South Worker who works by virtue of an employment relationship has the right to the protections provided for by Law 81/2017 and by any applicable collective agreements;

 

2. THE WRITTEN AGREEMENT.

 

The employer must submit a written agreement to the South Worker to establish the methods of carrying out the work performance in "smart" mode. The agreement can be permanent or fixed-term. The work must be organized by cycles, phases or objectives and not rigidly limited in space and time;

 

3. THE WORKPLACES.

 

The South Worker has the right to carry out work also outside the company premises. The agreement will define the places where it will be possible to work in "smart" mode. It is in the interest of the South Worker to include as many places as possible: from their home to coworking spaces.

 

4. WORKING HOURS - RIGHT TO DISCONNECT.

 

The South Worker works without specific time constraints. This is why it is important that the “right to disconnect” is guaranteed, thanks to which the South Worker will have time to dedicate to personal life.

 

5. WORK TOOLS.

 

The employer is required to provide the South Worker with the technological tools to work and is responsible for their proper functioning. The South Worker may request that a workstation be set up, at the expense of the employer, in the place where work will be primarily carried out, such as at home.

 

6. NON-DISCRIMINATION.

 

The South Worker has the right to an overall treatment that is at least equal to the one applicable to the colleagues who carry out the same activities at the company premises.

 

7. TRAINING.

 

The South Worker may have the right to continuous learning and to certification of any related skills.

 

8. HEALTH AND SAFETY.

 

The employer ensures the health and safety of the South Worker. To this end, the employee receives information at least annually describing the risks associated with the work activity.

 

9. ACCIDENTS AND PROFESSIONAL DISEASES.

 

The South Worker has the right to protection against accidents at work and occupational diseases.

 

10. BACK TO THE PAST.  

 

The agreements governing “smart” working  for indefinite duration, must provide for a notice period of no less than 30 days for the request to the South Worker to return at the office premises.

 

11. REFUNDS OF TRAVEL EXPENSES.

 

The agreement should specify that all costs related to travelling to the office premises, on a temporary or permanent basis, for meetings, presentations, training courses and the like, are expensed by the employer.

 

12. CHECKS AND SANCTIONS.

 

The South Worker has the right to know, through the agreement, how the employer will monitor work performance and which conducts may result in disciplinary sanctions.
